General information on data processing<\/strong><\/p>\n

On the basis of the rental contract concluded with us or a legal requirement, you may be obliged to provide personal data, in particular insofar as this is necessary for the fulfilment of your own contractual or statutory obligations. In this respect, failure to provide data may make you liable to a fine or to pay damages. Insofar as the provision of your data is necessary for the fulfilment of our obligations, there is an obligation (Obliegenheit) on your part. A refusal may result in the loss of your entitlement to performance as well as claims for damages on our part.<\/p>\n

You are not subject to automated decision-making within the meaning of Art. 22 GDPR.<\/p>\n

Your personal data is not transferred to third countries.<\/p>\n

Purpose and legal basis of data processing<\/strong><\/p>\n

We process your data exclusively for the conclusion and performance of the rental contract with you. This includes, for example, communication with you, arranging a viewing appointment, the provision, handover and taking back of the rental vehicle, or invoicing. Key documents such as the rental contract or the handover report are stored in paper form. Our legal basis in this respect is Art. 6 para. 1 b GDPR, which permits data processing for the performance of a contract and for the implementation of pre-contractual measures. Insofar as we are additionally legally obliged to process your data, for example to comply with retention obligations or to respond to requests from authorities, we rely on Art. 6 para. 1 c GDPR. Should problems arise in individual cases in the processing of the contract, we may also process your data to the extent necessary to clarify and resolve these problems. The legal basis is then Art. 6 para. 1 f GDPR. Our legitimate interest here consists in being able to defend ourselves appropriately against allegations or the assertion of legal claims.<\/p>\n

Storage period and data erasure<\/strong><\/p>\n

We erase your personal data as soon as the legal basis for its processing ceases to apply. Accordingly, we generally store your data only for the duration of our contractual relationship with you. In some cases, however, legal bases may also exist in parallel, or a new one may apply when a legal basis ceases to apply. Thus, after the end of the contract of use, there are statutory retention obligations for certain documents and information, which may be up to 10 years. We erase all personal data covered by this only when the storage obligation expires. If we are permitted to store data on the basis of our legitimate interest, we erase it as soon as the interest ceases to exist. With regard to possible legal claims arising from the rental relationship, this is the case at the latest when the limitation period expires (Verj\u00e4hrung). When this is the case depends on the type of claim. Typically, a claim becomes time-barred 3 years after the end of the year in which it arose, but in some cases after as little as 6 months.<\/p>\n

Right to object<\/strong><\/p>\n

Insofar as data processing is based on our legitimate interest, you have the right to object to the processing at any time. Your objection has effect only for the future. If you object to processing based on our legitimate interest, we may, except in cases of direct marketing, nevertheless continue the processing if we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms.<\/p>\n
